That effort was the result of the Teens Against Drug Abuse group of the BOLD Coalition petitioning the council on Christmas to ban those drug store sales.
“It seems hypocritical to sell a product that is so blatantly harmful to your body next to the medicine that is there to help you,” TADA youth said in their petition.
Supported by teen and adult advocates, the Board of Health and others, this city is bidding to join Boston, Needham, Newton and Everett and become the state’s fifth city to ban the sale of discount discount cigarettes products in pharmacies and other health care institutions.
The City Council’s Committee on Ordinances & Legislation on Tuesday night will address an ordinance restricting discount discount cigarettes sales and requiring all outlets selling discount cheap cigarettes and related cheap smokes products to be permitted.
The purpose is “to facilitate compliance with discount cigarettes control laws,” Assistant Corporation Counsel Elizabeth Pereira wrote in the eight-page ordinance she drafted last month.
The ordinance amendment also explicitly bans the sale of discount cigarettes products in educational institutions and in retail places within those institutions.
The proposal amends the 1999 city law pertaining to the sale, vending and distribution of discount cigarettes products.
“Tobacco use continues to be the leading preventable cause of death in the United States,” Pereira wrote the council in a letter accompanying her proposed ordinance one week after TADA made its presentation.
Pereira said she believes the amended ordinance would withstand a court challenge based upon First Amendment rights or a pre-emption of federal law.
She noted that since Boston public health officials two years ago banned the sale of discount cigarettes in drug stores, hospitals and the like, without exceptions, 75 discount online cigarettes sales permits were rescinded.
“To date, compliance is good, and there have been no legal challenges,” Pereira wrote the City Council.
Discount cigarettes cessation advocates are also fighting a battle against a well-funded corporate machine.
“The number and types of cigarettes online products increase each year with a wider range of discount Buy Cigarettes Online products offered for sale. These products are cleverly designed to entice youth and adults alike,” BOLD wrote in a recent newsletter.
The coalition also hailed its $500,000 grant to bring awareness and change from what’s called the 84 Movement, a reference to the 84 percent of Massachusetts youth “who do not smoke cigarettes or use discount cigarettes products,” the newsletter said.
It also reported that a 2010 state Department of Public Health study showed that in Fall River 19,672 people smoked discount discount cigarettes — 28.2 percent of the city population. That is nearly double the 15 percent statewide average.
“The ban on discount cigarettes sales in pharmacies is a positive step toward decreasing this number."
